Fair Housing by Design: Lawful Program Criteria in a Shifting Federal Landscape

As HUD’s enforcement posture evolves, while federal, state, and local complaint filings continue to rise, housing agencies face increased exposure around how programs are designed, described, and implemented. This session focuses on practical risk management under the Fair Housing Act and applicable fair housing laws, with emphasis on eligibility criteria, preferences, and communications. Participants will learn how to consider protected class implications with lawful approaches that withstand scrutiny while preserving core program objectives. The session also explores how agencies can continue to meet fair housing responsibilities in an environment where federal guidance on issues such as DEI and AFFH appear to be shifting. Attendees will leave with concrete tools to strengthen compliance while maintaining impactful outcomes in their communities.
